Job Creators Network Foundation Urges Supreme Court to Rein In Unaccountable Independent Agencies
Elaine Parker, President of Job Creators Network Foundation, issued the following statement regarding an amicus brief the Job Creators Network Foundation Legal Action Fund joined asking the Supreme Court to grant certiorari in Consumers Research et al. v. Consumer Product Safety Commission. The case challenges the constitutionality of the CPSC’s structure since Commissioners can only be removed by the President for cause despite the fact the Commission has significant enforcement and executive power.
“Small businesses continue to suffer under the weight of regulations and enforcement actions taken by unelected government bureaucrats. Next term the Supreme Court has an opportunity to further rein in these unelected officials by hearing this important case challenging the constitutionality of the Consumer Product Safety Commission’s structure. It is unconstitutional for CPSC commissioners to have significant executive power, including the power to take enforcement action against companies, yet have no accountability to the President of the United States.”
