JCNF Applauds Trump for Calling Out Regulation that Harms Innovation, Restricts Patient Choice

Healthcare reform should be rooted in competition, choice, and transparency, not bureaucratic manipulation

Washington, D.C. (April 16, 2025)—This week, the Trump administration issued an executive order calling on HHS Secretary RFK Jr. to work with Congress on addressing government manipulation within the prescription drug market. More specifically, the White House highlighted a particularly problematic regulation called the “pill penalty,” which distorts investment in new small molecule drugs—typically taken in pill form—versus biologic products administered in a clinical setting.

Legislation nicknamed the EPIC Act has already been proposed in Congress to address the problem. In the wake of President Trump’s directive, lawmakers should push the bill forward.
